Avrupa Vatandaşı İşçilerin Serbest Dolaşım Hakkının Kısıtlanması

Abstract

The free movement of persons constitutes one of the core rights linked to Europeancitizenship. It's known that the European Union has completed its largest enlargementthroughout his history on 1 May, 2004. Within this fifth enlargement, the old memberstates acting with an ultimate goal of protecting their own labour markets, have imposedsome restrictions relying legally on the Act of Accession, upon the exercise of the right offree movement of persons by the new member states' nationals. Hence, in this study, thecontent and the legality of the restrictions regarding the free movement of persons thathave been in force from the initial date of the accession and the relevance of the particularsubject related to full membership of Turkey in the light of the new developments areexamined.Kisilerin serbest dolasımı, Avrupa vatandaslıgına baglı temel bir hak niteligindedir.Bilindigi gibi, Avrupa Birligi, 1 Mayıs 2004'te tarihinin en büyük genislemesinigerçeklestirmistir. Besinci genislemeyle birlikte, Birlige üye eski devletler, isgücüpiyasalarını korumak amacıyla yeni üye devlet vatandaslarının Birlik sınırlarıiçerisinde serbest dolasım haklarını kullanmaları önünde hukuki dayanagını KatılımAntlasması'nda bulan birtakım kısıtlamalar getirmislerdir. Bu çalısmanın konusunu, katılımtarihinden itibaren uygulamaya konulan serbest dolasım hakkına iliskin kısıtlamalarınkapsamı ve hukuki niteligi ile konunun güncel gelismeler ısıgında Türkiye'nin tam üyeligiaçısından incelenmesi olusturmaktadır.
