Abstract

"Ceza Muhakemesi Hukukunda Belge İncelenmesi" başlığını taşıyan bu tez çalışmasında, delil ve ispat kavramı çerçevesinde, belge delillerine değinilmiş, belgeler üzerinde yapılan sahtecilik çeşitleri ve bu sahteciliklerin ortaya çıkarılmasında görevli bilirkişilik müessesesi irdelenmiş, sahteciliğe konu olan suç çeşitleri hakkında bilgiler verilmiştir. Çalışmada güvenlik ve adaleti sağlamakla görevli kişilere yol göstermesi için belgeler üzerinde kullanılmakta olan güvenlik özelliklerini içeren resimler ile üzerinde sahtecilik yapılmış belge resimlerine yer verilmiştir. Belge incelemeleri esnasında en çok karşılaşılan el yazısı ve imza sorununa değinilmiş, imzaların nasıl atılması gerektiği ve mukayese el yazısı ve imzaların nasıl temin edilmeleri gerektiği anlatılmıştır. Tez çalışmasında, belge incelemelerinde karşılaşılan hukuki ve teknik sorunlar tespit edilerek, elde edilen verilerden yararlanılarak bir takım öneriler sunulmuştur This study entitled "Forensic Document Examination under the Criminal Procedure Law? focuses on the framework of the forgery and counterfeiting on documents, proof of the evidence on forged documents and expertise of Forensic Document Examiners. This study also analyses how to investigate forged documents and variety of counterfeiting. In the study, the security features of official documents are discussed and pictured along with the forged documents in order to guide the security and justice personnel. Examining handwritings and signatures is one of the most common problems on document examinations. Thus, the methods of taking comparison handwriting and signatures are also explained in this study. In this thesis, legal and technical problems encountered in document examination are addressed and recommendations which are reflected by the data are presented
