İslam Hukuku, canlı ve yürürlükte olan bir hukuk sistemidir. Bunu naslara dayalı olarak yapılan içtihatlarla gerçekleştirmiştir. Mecelle'de ifade edildiği gibi "Zamanın değişmesiyle, hükümlerin değişmesi inkar edilemez." Delilini bilmeksizin başkasının hüküm ve re'yi ile amel etmek anlamına gelen ve içtihadın tam zıddı olan taklit, bilginlerin çoğu tarafından hoş görülmemiştir. Farklı görüş ve hükümleri birleştirmek anlamına gelen telfik ise VII. asır'dan itibaren usûlcüler arasında tartışılan bir konu olmuştur. İslam Hukukunda içtihada dayalı bir mesele olan telfik, genellikle fıkıh usûlü kaynaklarının taklit bölümünde ele alınmıştır. Aynı zamanda özel risalelere de konu olmuştur. Çalışmamız üç bölümden oluşmaktadır. Birinci bölümde, taklidin tanımı, taklidin uygulama alanı ve taklidi caiz görüp görmeyenler ve gerekçelerini ele aldık. İkinci bölümde, içtihatta ve taklitte telfiki inceledik, üçüncü ve son bölümde ise İslam Hukukunda telfik, İslam Hukuk ekollerinin telfike bakışı ve sakıncalı olan telfikin ne olduğu üzerinde durduk. The Islamic Jurisprudence is an active and valid law system. And it has realized this by convictions based on religios proofs. The change of time and the change of the jurisdictions –as explained in Mecelle- can't be denied. "Imıtation" meaning to act considering the jurisdictions and the opinions of others without knowing their proofs has never been tolerated by scholars. "Telfiq" meaning to connect the variative opinions and jurisdictions however is a subject discussed among methodists from the seventh century. Telfiq that is a convictional subject of the Islamic Jurisprudence and is usually treated in the taqlid imitation chapture of islamic method books. It forms also a subject of special booklets. Our study is composed of three parts. In the first part we held the meaning of "imitation", the usage area of it and held who accepted or not accepted imitation with their causes.In the second part we worked on "telfiq" on religious proofs and imitation. And in the third and the last part we pointed on telfiq within Islamic Law , the point of wiev of Islamic methods to telfiq and on the inconvenient telfiq, |
