Abstract:
Çalışma süreleri, Avrupa Birliği sosyal politikası, Uluslararası Çalışma Örgütü ve Türk İş hukuku kapsamında, işçilerin yaşam ve çalışma koşullarını geliştirme hedefleri arasındadır. Çalışma sürelerine dair ilk düzenlemeler Uluslararası Çalışma Örgütü sözleşmeleri ile yapılmıştır. Avrupa Birliğinde de benzer nitelikteki çalışma sürelerine dair yasal düzenlemeler vardır. Bunlardan en temel düzenleme 2003/88 sayılı Direktiftir. Direktif, gemi adamları, kara taşımacılığı, sivil hava taşımacılığı ve demir yolu taşımacılık sektörlerinde istihdam edilen mobil işçiler gibi meslek gruplarını kapsamamaktadır. Çalışma sürelerine ilişkin yasal düzenlemelerin temel amacı, iş sağlığı ve güvenliğinin korunmasıdır. Ancak daha zor ve tehlikeli olması nedeniyle gemi adamları bakımından hem ulusal hem de uluslararası alanda çalışma süreleri özel kanun ve yönetmelikler ile düzenlenmiştir. Bu çalışmada çalışma süreleri ve gemi adamlarının çalışma süreleri ulusal ve uluslararası yasal düzenlemeler ve Avrupa Birliği mevzuatı ışığında incelenmiştir Working time falls within the Eurpean Union?s social policy, International Labour Organization and also Turkish Labour Law goals of improving the living and working conditions of workers. The European Union legal instruments concerning working time are also similar with International Labour Law agreements. The basic instrument concerning organization of working time is Council Directive 2003/88. This Directive shall not apply to seafarers, mobil workers in civil aviation, mobile road transport workers and railway transport workers. The objective of organization of working time is to guarantee the protection of the safety and health of workers. As some group of workers are working harder and under dangerous conditions such as seafarers special laws and regulations have been specified in national and international law. In this doctora these seafarers? working time have been analyzed according to national, international law and also European Union regulations.
