Devlet memurları hakkında disiplin soruşturması: Türkiye uygulaması

Abstract

Bu çalışmada, Türkiye'de Devlet memurları hakkında yapılan disiplin soruşturması uygulamasına ilişkin esaslar ve soruşturma süreci incelenmektedir. Bu nedenle çalışmanın özünü; disiplin soruşturmasının temel esasları, soruşturma sürecinde yer alan unsurlar ve disiplin cezalarının uygulanmasından sonra bu müeyyidelere karşı başvuru yolları oluşturmaktadır. Ülkemizde, disiplin soruşturmasına ilişkin özel kanunlarda da çeşitli hükümler bulunmakla birlikte, çalışmamızda Devlet memurlarının tabi olduğu genel kanun olan 657 sayılı Devlet Memurları Kanununda yer alan hükümler esas alınarak konu ele alınmıştır. Disiplin soruşturması uygulamalarında eleştiri konusu olan bazı cezaların yargıya götürülememesi sorunu, Anayasa ve 657 sayılı Kanunda değişiklik yapılarak ortadan kaldırılmıştır. Böylece, Anayasa ve Kanunda yer alan çelişkili düzenlemelerden kaynaklanan boşluğun yargı mercilerince doldurulması ve bu çerçevede yaşanan mağduriyetler de giderilmeye çalışılmaktadır. Çalışmamızda da yer verdiğimiz, tüm disiplin cezalarına yargı yolunun açılmasına ilişkin düzenleme bu anlamda önemli bir gelişmedir. Bu çalışma üç bölüm halinde hazırlanmıştır. Birinci bölümde, disipline ilişkin kavramlar ve disiplin cezaları ele alınmıştır. İkinci bölümde, Türkiye'de disiplin soruşturması uygulamasına ilişkin süreç, soruşturma sürecinde yer alan disiplin amirleri ile yetkili kurullar, soruşturmalarda göz önünde bulundurulması gereken önemli hususlar ve görevden uzaklaştırma konuları incelenmiştir. Son bölümde ise, disiplin cezalarına karşı başvuru yolları ile disiplin affı konuları değerlendirilmiştir. In this study, the principles relating to the disciplinary investigation and the investigation process about the State officers in Turkey are examined. For this reason the essence of the work is related to the basic Fundamentals of the disciplinary investigation, the elements of discipline investigation process and the ways to apply against the sanctions after the implementation. In our country, although there are various provisions in particular laws regarding the disciplinary investigation, in this study we discussed the topic on the basis of the provisions contained in the law no: 657 that the State officers bounds. The problem of not being able to sue some of the punishments in the judiciary, which is the subject of criticism in the disciplinary investigation, is removed by some changes in Constitution and Law Number 657. Thus, the gap which is caused by the contradictory regulations of the Constitution and the law that filled by jurisdiction is prevented and in this context reconciliation is provided. In this sense regulations which open the path of the disciplinary penalties to the judiciary are important development. This study was prepared as three chapters. The first section discusses the concepts for the discipline and disciplinary penalties. The second section discusses the investigation process of the discipline, the administrator officers and authorized committees take place in this process, the important considerations about investigations and the topics about discharging from the job in Turkey. In the last section, a reference for the procedures to apply against the penalties and the forgiveness issues of discipline were assessed.
