İzmir büyükşehir bütünündeki büyük ölçekli yatırımların kent yönetimi, şehir ve bölge planlaması ve idari yargı açısından değerlendirilmesi

Abstract

Politik ve bürokratik kıskaç içindeki idari ve siyasi denetim mekanizmalarının yeterli olmadıgı, bir ülke gerçegidir. Dönemsellik, keyfilik, ideolojik ve menfaat iliskileri gibi soru isaretleri içindeki basın ve meslek odalarının kamuoyu olusturma anlamındaki soyut ve sorumsuz olan denetim mekanizmasının da ülke egitim düzeyi ve demokrasi kültürü açısından imkansız sınırlar içinde oldugu da baska bir hakikattir. Böylece Hukuk ve Planlama disiplini çerçevesinde olmayan kamu yönetimi anlayısı içinde alınan kararlar ile büyük ölçekli yatırımlara girisilmekte ve neticede söz konusu bu büyük ölçekli projeler için ciddi meblaglar harcayan kamu yönetimi ve özel sektörün ekonomik kayıpları ile ülke ekonomisine ciddi zararlar verilmektedir. Esasen denetim sisteminin yeniden olusturulması soyut söyleminden ziyade hızlı, adil ve uzmanlık disiplini içinde çalısacak bir "dari Yargı Sistem yilestirilmesi" yönünde yapılacak somut bir düzenleme, kısa vadede etkisini gösterecek ve diger denetim mekanizmalarının da zaman içinde saglıklı bir sekilde olusmasına vesile olacaktır. Bu modelin arastırılması anlamındaki çalısmada, kentin tarih içindeki yapısını inceledikten sonra planlama ve kentlesme kavramlarının stanbul ve Ankara örneklerine yansıması incelenmis ve somut örnek baglamında zmir ilinin bu yöndeki tarihi gelisimi ifade edilmis ve bu baglamda Hukuk Devleti içinde dari Yargı mekanizmasının yasal düzenlemesi ve genel uygulaması ortaya konmustur. Üçüncü bölümde ise kent içinde son yirmi bes senede gerçeklesen on üç projenin Sehir ve Bölge Planlaması, Kamu Yönetimi, dare Hukuku ve dari Yargıkapsamı içinde incelemesi gerçeklestirilmistir. Sonuç olarak çalısmada özelde on üç proje ama genelde tüm ülke kapsamındaki bu manadaki sorunların nedenlerinin tespiti ve bunların kente, kentliye ve ülke ekonomisine olan etkileri ile birlikte bunlara iliskin çözüm önerileri gelistirilmeye çalısılmıstır. It is a well-known fact that administrative and political supervision mechanisms are not sufficient since they are highly affected by difficult political and bureaucratic situations. It is another fact that abstract and irresponsible supervision mechanisms of press and trade associations having some question marks such as periodicity, arbitrariness, ideological and benefit-oriented relationships are located in impossible limitations in terms of education level and democratic culture in the country. In this way, people make large-scale investments with the decisions made in the context of public administration concept which is not within the scope of Law and Planning discipline and consequently national economy is severely damaged by the financial loss of public and private sectors spending large amounts of money for these large-scale projects. As a matter of fact, instead of the abstract claim that supervision system should be restructured, a concrete, fast and fair arrangement for the "Improvement of Administrative Procedure System" which will work within the scope of expertise discipline will take effect in the short run and conduce toward creation of other healthy supervision mechanisms in the long run.This study which is a research on this model, after examining the historical structure of the city, reflection of planning and urbanization concepts on stanbul and Ankara examples is examined and historical development of zmir in this context has been expressed as a concrete example and legal arrangement and general implementation of Administrative Procedure mechanism in the Constitutional State has been stated. In the third chapter, thirteen project carried out in the city in the last twenty five years have been examined in terms of City and Region Planning, Public Administration, Administrative Law and Administrative Procedure. In the fourth chapter, specifically thirteen project but in general identifying the reasons of the problems inthe country and their effects to the city, people living in the city and national economy and developing solutions to these problems have been argued.
