Abstract:
Etkili bir konut finansman sistemi, hem tüketicilerin konut talebinin karşılanması hem de inşaat ve finans sektörlerinin gelişimi açısından büyük öneme sahiptir. Sistem, konut kredilerinden oluşan alacaklara dayalı sermaye piyasası araçlarının ihracı suretiyle işlerlik kazanmaktadır. Kısaca "menkul kıymetleştirme" denilen bu sistem tezin ana konusunu oluşturmaktadır. 2007 yılının ilk çeyreğinde ipotekli konut finansman kanunu Türkiye'de yasalaşmıştır. 2007 yılının ikinci yarısında ise ABD'de başlayan "mortgage" kaynaklı küresel mali kriz tüm dünyayı etkisi altına almıştır. Bu gerekçeler konuya olan ilgiyi artırmıştır. Bu gelişmeler çerçevesinde ipotekli konut finansman sisteminin ülkemiz uygulamalarında daha sık tartışılacağı ve gelişmeye açık olduğu ifade edilebilir. Bu tezde ipotekli konut finansman sisteminin önemi ve Türkiye'de uygulanabilirliği ele alınmaktadır. Bu çerçevede ilk bölümde ipotekli konut finansman sisteminin genel özellikleri, tarafları ve araçları ile ilgili bilgiler verilmektedir. İkinci bölümde dünyada ipotekli konut finansman sisteminin uygulamaları anlatılmıştır. Son bölümde ise Türkiye'de yakın geçmişte yasalaşan ipotekli konut finansman kanununun getirdiği yeniliklere ve sistemine yer verilmiştir. An efficient housing finance system has a big role in both meeting housing demands for the consumers and in the development of the construction and finance sectors in the economy. The housing finance system begins to function thereby the capital markets instruments issue provided by securitization of the receivables which arises from housing loan. Shortly system of the name "securitization" is the main subject of thesis. In the first quarter of 2007 mortgage law has been legislated. In the second half of the 2007, financial crisis originated from mortgage has started in USA which causes global effects. All these reasons increase our interest in this subject. Thereforeæ it can be stated that in our country's applications mortgage will be argued more often and tend to progression. In this thesis, the importance of housing finance system and applicability in Turkey has been studied. In the first section of this study, general characteristics, institutions and instruments of housing finance system are explained. Applications of the housing finance system in the world take place in the second section of the thesis. In the last section, recently innovations brought by the mortgage law were legislated and its system in Turkey is examined. Keywords: Mortgage, securitization, housing finance, housing loans.
