Sosyal sigortalarda asgari işçilik uygulaması

Abstract

Sosyal Sigortalarda asgari işçilik, özel inşaat ve ihaleli işlerde, Sosyal Güvenlik Kurumunun, daha önceden her iş için belirlediği asgari işçilik oranlarının, yapılan işin toplam tutarına uygulanması sonucu ortaya çıkan en az işçilik tutarını, devamlı işyerlerinde iseæ işin emsaline, niteliğine, kapsam ve kapasitesine göre işin yürütümü açısından gerekli olan sigortalı sayısının, çalışma süresinin veya prime esas kazançlarının toplam tutarını ifade eder. Eğer işveren bu tutarların altında bir bildirimde bulunursa, bu durumda, işin yürütümü açısından gerekli olan asgari işçilik özel inşaat ve ihaleli işlerde eksik olan işçilik tutarı Kurum tarafından re'sen tahakkuk ettirilerek sigortalılara mal edilmeden işverenden tahsil edilir. Devamlı işyerlerinde iseæ bu tespitler Kurumun denetim ve kontrolle görevlendirilmiş memurları tarafından yapılır. Çalışmamızda, Sosyal Sigortalarda asgari işçilik uygulaması, tarihsel süreç içerisinde, uygulanan dönem ve ilgili dönemin yasal ilkeleri çerçevesinde sistematik bir şekilde irdelenmiştir. The minimum workmanship in social security means, in private constructions and tender jobs, the amount of minimum labor that is found after the minimum workmanship rates determined by the Social Security Institution for each job are proportioned to the total amount of the job being deliveredæ where, social security in continuous business places means the total amount of number of insured employees necessary for the conduct of business as well as duration of work or the earnings that form the basis of premiums according to the precedents, quality, scope and capacity of work. If the employer declares an amount below aforementioned amounts, Security Institution realizes ex officio the deficient labor amount in private construction and tender jobs that is necessary for the conduct of work and this amount is collected from the employers without causing any cost on the part of the employees. In continuous business places, on the other hand, such deficiencies are detected by the auditing and controlling officers of the Institution. In our study, the application of minimum labor has been examined in a systematic way within the frame of legal principles of the relevant period and of the period in which it is applied.
