Azerbaycan Anayasasında yürütme erki

Abstract

Yer altı ve yerüstü zenginliklerinden dolayı devamlı dikkatleri üzerine çeken ve uzun yıllar degisik devletlerin baskı ve sömürüsü altında yasam mücadelesi veren Azerbaycan, bagımsızlıgını kazandıktan sonra degisik alanlarda birçok reformlar yapmıstır. Bunlardan en önemlilerinden bir tanesi de yeni bir anayasanın yapılmasıdır. Bagımsızlıga vurgu yapan, temel hak ve özgürlüklerden uzun ve ayrıntılı bir sekilde bahseden bu Anayasa Azerbaycan?ın bagımsızlıgının temellerini güçlendirmektedir. Azerbaycan Anayasası ?Baskanlık? sisteminin özelliklerini tasımaktadır. Azerbaycan Anayasası erkler ayrılıgını anayasal bir kural haline getirmistir. Buna göre yasama yetkisi Azerbaycan Cumhuriyeti?nin Milli Meclisine, yürütme yetkisi Azerbaycan Cumhuriyeti?nin Devlet Baskanına aittir. Yargı yetkisi ise Azerbaycan Cumhuriyeti?nin mahkemelerince kullanılır. Azerbaycan yürütme sisteminde hatta denebilir ki, Anayasa sisteminde Baskan sistemin merkezinde yer almaktadır. Bunun en önemli göstergesi, Devlet Baskanlıgı makamının, Azerbaycan Anayasasının ?Devletin Esasları? baslıgını tasıyan II. Bölümünde düzenlenmis olmasıdır. Bu bölümde, ?Azerbaycan Devletinin Bası? baslıgını tasıyan 8. madde Devlet Baskanlıgı makamını devletin temelleri arasında saymaktadır.
