Abstract:
Hukukun ekonomi ile bağlantılı alanlarını düzenleyen kısmı da ekonomik hayatın değişmesi, dengelerin farklılaşması ve beklenen faydaların çeşitlenmesi sonucunda değişip gelişmektedir. Günümüzün ekonomik ve sosyal koşulları şirketler arasında merkezi yoğunlaşma olgusunu güçlendirmekte ve bu doğrultuda şirket toplulukları kavramı önem kazanmaktadır. Merkezi yoğunlaşma neticesinde güçlerini birleştiren şirketler piyasa koşullarında daha kolay rekabet edebilmektedir. Ana şirket ve ana şirkete ekonomik, sosyal ve organizasyonel anlamda bağlı olan fakat ana şirketten ayrı ve bağımsız bir hukuki kişiliğe sahip olan bu şirketler şirket topluluklarını meydana getirmektedir. Bağlı şirketler bakımından ana şirkete bağımlılık ve hukuki bağımsızlık unsurlarının bir arada bulunması şirket topluluğu bünyesindeki iş ilişkilerinde bir takım sorunların doğmasına neden olabilmektedir. Şirket Topluluklarında Üçlü İş İlişkileri ve İş Güvencesi Sorunları başlığını taşıyan çalışmada şirket toplulukları, şirket topluluklarında ortaya çıkabilecek birlikte istihdam, geçici iş ilişkisi, iş sözleşmesinin devri şeklindeki üçlü iş ilişkileri ve şirket topluluklarında iş güvencesi sorunları incelenecektir. The law regulations concerning the economic field evolves in conjunction with the economical life which changes, differenties and expands for the expected benefits. With the economic and social aspects of the life, enterprises tend to join together for centralization, which brings multicorporate enterprises as one of the most important structure. With the centralization process, enterprises have better chance to be able to compete in the market conditions they operate. Multicorporate enterprises consists of the major enterprise and the dependent enterprises which are bound to major enterprise with economic, social and organizational ways, with the exception of holding their own legal titles independently. The conflicts regarding labour relations might occur frequently concerning the dependent enterprises, which is bound the multicorporate enterprise in the nature of the legal independency and organizational dependency of the dependent enterprises. In the study, titled Triple Labour Relations in Multicorporate Enterprises and Labour Security Conflicts; multicorporate enterprises, triple labour relations structured as, cooperate employment, temporary labour relationship, transfer of labour contract that might occur in multicorporate enterprises, and labour security conflicts in multicorporate enterprises, will be concidered.
