İcra takibi, iki taraf sistemi üzerine kurulmuştur. Takibin tarafları, alacaklı ile borçludur. Alacaklı, icra takibini başlatan, talepte bulunan kimsedir; borçlu ise takipte borçlu olarak gösterilen kimsedir. Bazı durumlarda ise alacaklı veya borçlu tarafta, birden çok kimse yer alabilir. İcra takibinde alacaklı ve borçlu tarafta birden fazla kimsenin olması durumunda, takip arkadaşlığı söz konusu olur. Takip arkadaşlığının iki türü vardır. Bunlar, mecburi takip arkadaşlığı ve ihtiyari takip arkadaşlığıdır. Takipte alacaklı veya borçlu tarafta birden çok kimsenin bulunması zorunlu ise, mecburi takip arkadaşlığından; birden çok kimsenin bulunması isteğe bağlı ise ihtiyari takip arkadaşlığından bahsedilir. Alacaklı tarafta mecburi takip arkadaşlığının olduğu hallerde, alacaklıların icra taraf işlemlerini hep birlikte yapmaları, kural olarak, zorunludur. Borçlu tarafta mecburi takip arkadaşlığı söz konusu ise icra memuru, icra işlemlerini borçluların tümüne karşı yapmalıdır. İhtiyari takip arkadaşlığında ise, takip arkadaşlarının her biri, diğerinden bağımsız olarak hareket edebilir. Bunun sonucu olarak da alacaklı taraftaki takip arkadaşlarından her biri tek başına taraf takip işlemi yapabilir, borçlular hakkında da icra takip işlemleri ayrı ayrı yapılacaktır. Bu çalışmanın birinci bölümünde, takip arkadaşlığı hakkında genel bilgilere yer verilecektir. İkinci bölümde ise, mecburi ve ihtiyari takip arkadaşlığının ne zaman söz konusu olduğu tespit edilmeye çalışılacaktır. Son olarak çalışmamızın üçüncü bölümünde ise, takip arkadaşlığının hüküm ve sonuçlarına ilişkin açıklamada bulunulacaktır. Enforcement proceeding is based on two parties. Parties of the enforcement procedure are creditor and debtor. Creditor is the person who initiates the enforcement process and claims his credit; whereas the debtor is shown as the debtor in this process. In some situations there might be more than one person as creditor or debtor. When there are more than one creditor or debtor, joinder of enforcement exists. There are two types of joinder of enforcement. These are compulsory and permissive joinder of enforcement. When the existence of more than one person as creditor or debtor is obligatory in the enforcement process, there is a compulsory joinder of enforcement. When this situation is arbitrary, we might discuss premissive joinder of enforcement. The existence of obligatory joinder of enforcement for creditor requires all creditors to carry out all procedural transactions together. When debtor involves in joinder of enforcement, the enforcement officer has to carry out all procedural transactiosnagainst all debtors. Permissive joinder of enforcement enables people who are involved in the joinder to act independently. As a result of this fact each creditor can transact on his own and these transactions might be carried out against debtors seperately. First chapter of this thesis includes general information on joinder of enforcement. Second chapter tries to determine when there is obligatory and when there is permissive joinder. Last chapter covers legal consequences of joinder of enforcement. |
