Abstract

İslam Hukuku'nun medeni hukuk alanında ilk kanunlaştırma örneği Mecelle'dir. Mecelle yalnız ülkemizde değil, Tunus, Irak, İsrail, Fas gibi birçok ülkenin de medeni hukukunun oluşmasında ilham kaynağı olmuştur. İşte bundan dolayı anlaşılabilmesi için Mecelle üzerine birçok şerh yazılmıştır. Çalışmamızın konusunu oluşturan Ali Haydar Efendi'nin ?Dürerü'l-Hükkam Şerhu Mecelleti'l-Ahkam? adlı eseri de Mecelle'nin en önemli şerhlerinden birisidir. Çalışmamız ?Dürerü'l-Hükkam? adlı eserin icare bahsi ile alakalı bilgileri içeren 404-457. maddelerinin kaynaklarının tespit ve tahkikinden oluşmaktadır. Kaynakların tespit ve tahkikini yapmadan önce ilgilenenlerin metinden faydalanmalarını kolaylaştırmak amacıyla metni latinize ettik. Bunu yaparken mümkün olduğunca metnin aslına sadık kalmaya özen gösterdik. Tezimiz bir giriş ve üç bölümden oluşmaktadır. Bölüm kısımları çalışmamızın konusunu oluşturan maddelerin latinize ve tahkik edilmesiyle meydana getirilmiştir. Çalışmamızın amacı zikrettiğimiz bölümün latinize ve kaynaklarının tahkik çalışmasını yaparak İslam Hukukçularının ve İslam Hukukuyla ilgilenenlerin bu eserden faydalanmalarını kolaylaştırmaktır. Mecelle can be accepted as the first example of the canonization process of Islamic jurisprudence in the area of civil law. It also has been a source of inspiration in the formation civil law altogether. It is not only popular and used in Turkey but most of the Islamic world such a Tunusia, Irak, Israil, Morocco and some others places. So many commentaries which written were on it can show us the importance of Mecelle by itself Ali Haydar Efendi?s ?Dürerü?l-Hükkam Şerhu Mecelleti?l-Ahkam?, which was studied by us, is considered as one of the important commentary on it. Our work consist of the sources determination and verification of 404-457 items that is relevant with the magic part of ?Dürerü?l-Hükkam? of hiswork. Before making the sources determination and verification, we latinize the text in order to make it easier those interested to benefit from the text. In doing so, we make an effort as much as possible to be loyal to the original text. We have given information about Ali Haydar Efendi?s Works in the introduction of our thesis. And we have made latinization and verification work of 404- 457 items in the main section as well. The aim of our study is to make it understandable for the student of Islamic jurisprudence and the reader study who interest which Islamic law to benefit from this book by making latinization and verification work of the section that we said previously.
